General terms and conditions

1. Definitions
In these general terms and conditions, the following definitions apply:

i. The Foundation: The Women’s Health Care Center Foundation, based in Amsterdam, which, according to its statutes, aims to provide responsible specialist medical care in the fields of gynecology, obstetrics, urology, radiology, and ultrasound in the broadest sense. To deliver medical care, the Women’s Health Care Center Foundation has entered into an outsourcing agreement with Alle Vrouwen Gezond B.V., to which these terms and conditions apply accordingly.

ii. ZBC: The independent treatment center for medical care operating under the name “Women’s Healthcare Center” offering the specialist medical care provided by the entity referred to under i.

iii. Treatment Agreement: All agreements entered into between the ZBC and/or its partners at Women’s Healthcare Center and a patient regarding treatment.

iv. Patient: The counterparty to the ZBC when entering into the treatment agreement and/or their legal representative. The treatment agreement may be established either in writing or verbally.

v. Treatment: A day treatment, outpatient treatment or consultation, medical examinations, and any other services provided, whether specialist medical or otherwise.

vi. These terms and conditions apply to the services/treatments provided by the Women’s Healthcare Center.

2. Deviations
A deviation from these general terms and conditions is only valid if the ZBC has explicitly agreed to it.

3. Cancellation Policy
Appointments canceled less than 24 hours in advance or missed without prior notification may be charged to the patient. The ZBC's administration serves as full proof that such an appointment was made, unless proven otherwise.

4. Identification
Every patient must present a legally recognized ID at the ZBC's first request and, if the treatment falls under insured care, proof of health insurance coverage. Failure to provide this may result in the suspension of the treatment agreement, except in cases requiring urgent care. 

5. Cost Information
Before treatment, the patient will be informed whether the treatment is eligible for reimbursement and what the costs will be if it is not covered by insurance.

6. Medical Data Access
By entering into a treatment agreement, the patient consents to allow healthcare providers access to their electronic medical file, both within and outside the ZBC, as necessary for optimal care. ZBC ensures that all its employees accessing such files have signed a confidentiality agreement.

7. Advance Payment
The ZBC may require full or partial prepayment or security for the estimated cost of the treatment. Lack of prepayment does not authorize delaying or withholding urgent care. The physician will assess whether urgent care is required.

8. Termination or Suspension
The treatment agreement may be suspended or terminated for serious reasons, such as aggressive behavior towards ZBC staff, volunteers, or other patients. In such cases, the ZBC is still responsible for providing necessary aftercare.

9. Medical Records Retention
Medical records will generally be retained for fifteen years or longer if reasonably necessary for proper care.

10. Record Deletion
Upon request, ZBC will delete the patient's records within three months unless there is a significant interest in retaining them or legal obligations prevent deletion.

11. Standards of Care
The ZBC ensures that healthcare providers act according to professional standards and responsibilities.

12. Billing
If billing to the insurer is not possible, the ZBC will invoice the patient directly. The payment term is thirty days from the invoice date, extendable if the patient proves late receipt.

13. Collection Costs
If payment remains outstanding after a reminder, the claim will be handed over for collection, and the outstanding amount will be increased by collection costs of 15% of the principal sum, with a minimum of €100.

14. Authorization for Insurer Payment
The patient authorizes the ZBC to claim payment from the health insurer for the insured part of the costs and provides necessary insurance details.

15. Insurance Awareness
Patients are expected to know their insurance terms before entering into the treatment agreement.

16. Tariff Changes
The ZBC reserves the right to change treatment tariffs without notice, in accordance with pricing regulations. If no regulations apply, the rates published at the time of treatment apply.

17. No Set-off
Patients cannot invoke a right of set-off against claims by the ZBC.

18. Newsletter
Only with the patient’s consent will the ZBC use address details to send information about Women’s Healthcare Center and its products. The newsletter is sent directly by WHC, without third-party involvement. No personal information will be sold or shared with external parties.

19. Property Protection
The ZBC will take reasonable measures to prevent damage to or loss of the patient's property.

20. Patient Responsibility
Patients must take appropriate care to prevent damage to or loss of their belongings.

21. Liability
The ZBC is not liable for damage or theft of patient property if the measures described in article 19 were taken.

22. Governing Law
All agreements between the ZBC and the patient are governed by Dutch law.
